The first-instance verdict of the lawyer's lawsuit against Pinduoduo for price-cutting fraud was announced, and the court found that the defendant violated the right to know

On July 5, according to Jiemian News, citing the Shanghai Changning Court WeChat account, the Shanghai Changning District People's Court publicly pronounced a verdict on the Internet infringement liability dispute case between Liu Moumou and Shanghai Xunmeng Information Technology Co., Ltd. (Pinduoduo operator). The court determined that the defendant had infringed the right to know, and the first instance ruled that the defendant should compensate the plaintiff for losses of 400 yuan within ten days from the date of the judgment's effectiveness; the plaintiff's other claims were rejected. The court believes that e-commerce operators should disclose activity information in a comprehensive, truthful, accurate and timely manner when carrying out "new customer acquisition activities" to protect consumers' right to know. If the information disclosure does not meet the statutory requirements or is ambiguous, it constitutes an infringement of consumers' right to know and should bear the corresponding tort liability.

It is reported that on July 1, before the verdict of the case, lawyer Liu Yuhang said on Zhihu that the Pinduoduo bargaining case, which took more than a year and 5 court hearings, is finally about to usher in the first-instance judgment. Today, I received a notice that the case will be sentenced online at 11 am on July 5, 2022. To be honest, when I filed the lawsuit, I could never have imagined that a small ordinary civil case with a subject matter of 9.9 yuan would take such a long trial time. Looking back on the entire litigation process, I have to sigh at the strength of the opponent. Not counting the evidence, this case only has hundreds of pages of various opinions written by both parties.

In March 2021, Shanghai lawyer Liu Yuhang participated in Pinduoduo's "Bargain for Free" event because of a link shared by a friend. He received a "super free card" and invited many people to bargain, but the difference was always "0.9%". Liu Yuhang suspected that Pinduoduo's data was not true, and submitted prosecution materials to the court on the grounds that Pinduoduo was suspected of violating the principle of honesty and trustworthiness when providing network services and using false data to conceal the rules, which constituted fraud. In the documents released by Liu Yuhang later, it was learned that Pinduoduo said that "because the page has a limited number of digits for displaying percentages, they omitted a percentage with at least 6 decimal places and displayed it as 0.9%. The 0.9% displayed on the bargaining page is not 0.9%, but 0.9996427%."

In response to this, Pinduoduo said that the "bargain for free" activity was real and effective, with more than 1,200 products participating in this period and a total of 7.09 million products given away. Regarding the lawyer's invitation to many people to bargain but the bargaining progress bar did not change, Tang Jiangrong, senior director of Pinduoduo's legal department, explained: "Because some of the free bargaining products are priced large, the amount of money bargained by a small number of users is not enough to change the percentage, which will make consumers think that the bargaining has not changed."
