On August 2, the Ministry of Industry and Information Technology issued the "Notice on Further Strengthening the Access, Recall and Software Online Upgrade Management of Intelligent Connected Vehicles" (draft for comments) on August 1, which intends to strengthen the safety management of combined driving assistance, strengthen the collaborative management of OTA upgrades, and standardize the combined driving assistance and OTA upgrade behaviors of automobile manufacturers.


It points out that supervision and management of OTA upgrade activities should be strengthened. Before implementing OTA upgrade activities, enterprises should ensure that automobile products comply with relevant requirements such as national laws and regulations, technical standards and technical specifications, and file with the Ministry of Industry and Information Technology and the State Administration for Market Regulation in accordance with relevant requirements. The filing content includes enterprise management capabilities, vehicle models and functions, specific upgrade activities and relevant supporting materials. Enterprises can only carry out OTA upgrade activities after the filing is completed. Changes to product technical parameters should be reported to the Ministry of Industry and Information Technology before filing to ensure the consistency of automobile product production. The State Administration for Market Regulation promptly conducts filing assessments and supervision and inspections, standardizes the application methods of OTA upgrades, and prevents enterprises from concealing vehicle defects or evading responsibilities through OTA upgrades.


It points out that it is planned to improve the reporting and judgment mechanism of incidents and accidents. When enterprises learn that the products they produce and sell have safety incidents such as failure of the combined driving assistance system or exceeding the system boundary, resulting in function exit, and vehicles equipped with combined driving assistance systems have collisions, remote control and other accidents, they shall report to the Ministry of Industry and Information Technology and the State Administration for Market Regulation in accordance with relevant requirements. The Ministry of Industry and Information Technology will strengthen the analysis and judgment of incident and accident reports, and timely optimize and adjust access requirements and product technical standards. The State Administration for Market Regulation will strengthen in-depth investigation of accidents and defect judgment, and strengthen the supervision of automobile product safety and recall.


The "Notice" will further strengthen departmental coordination, enrich and improve the policy system for intelligent connected vehicles, strengthen the management and guidance of R&D, production, and use, and ensure the high-quality development of the intelligent connected vehicle industry.
