Chinese court makes first global rate ruling in OPPO v. Nokia case

Recently, the Chongqing No. 1 Intermediate People's Court made a judgment on the case of OPPO v. Nokia's standard essential patent royalties dispute, confirming the global fair, reasonable and non-discriminatory (FRAND) rate for Nokia's standard essential patents.


This judgment is the first time that a Chinese court has issued a global rate judgment on standard essential patent litigation. In 2021, the Supreme People's Court made the final ruling for the first time in the "OPPO Sharp Standard Essential Patent Licensing Dispute Case" that Chinese courts have global rate jurisdiction over standard patents.


OPPO Chief Intellectual Property Officer Feng Ying said: "OPPO is willing to abide by and implement the global FRAND licensing fee for Nokia patents determined by the court judgment, and hopes to actively resolve the patent licensing fee dispute with Nokia. OPPO hopes that Nokia can abide by and Implement the Chongqing Court’s global fee ruling. OPPO respects intellectual property rights and advocates reasonable fees, advocates the establishment of a long-term and healthy intellectual property ecosystem, advocates the resolution of intellectual property disputes between licensors and licensees through friendly negotiation, and mutual respect for the value of patents. ”
