The National Intellectual Property Administration maintains the validity of a patent related to an electronic device of Critical Information

Recently, the State Intellectual Property Office issued a "Decision on the Examination of the Request for Invalidation", with decision number 51403 and patent number 201310281715.4, maintaining the validity of the patent right. The patent owner is Guangzhou Yanji Information Technology Co., Ltd. (hereinafter referred to as Yanji Information), and the invalidation requester is Tantan Technology (Beijing) Co., Ltd. (hereinafter referred to as Tantan Technology).

In February 2021, TanTan Technology submitted a request for invalidation to the National Intellectual Property Administration, involving the patent for "electronic device communication method, electronic device and electronic device communication system" of critical information.

After review by the State Intellectual Property Office, the invention patent No. 201310281715.4 was maintained valid.

Key points for decision: If the technical solution defined in a claim has distinguishing features relative to the technical content disclosed in the prior art, but other prior arts do not provide clear technical inspiration, and there is no evidence to prove that the distinguishing features belong to the common knowledge in the field, and the distinguishing technical features bring beneficial technical effects to the technical solution defined in the claim, then the claim has an inventive step.
