Apple has failed in its bid to reduce the patent infringement fees it owes VirnetX, losing an appeal that could have vacated or reduced $502.8 million in damages,media reported.


A federal judge today rejected Apple's request for a retrial, arguing that the amount of damages should not exceed $113.7 million, Reuters reported.


The judge said Apple must pay $502.8 million in a fine awarded in October 2020, plus a previous $454 million, and that this amount, future royalties and interest could result in Apple having to pay VirnetX more than $1.1 billion.


In both VirnetX lawsuits against Apple, jurors ruled in favor of VirnetX and said Apple's FaceTime, iMessage and VPN On Demand features infringed VirnetX patents related to communications security.


Next, Apple will need to pay 84 cents for each iPhone or iPad sold in the future. Apple has claimed that future royalties should be zero or no more than 19 cents.


The legal battle between the two companies has lasted for more than 10 years since it first broke out in 2010.
