Under the agreement, ZTE will pay a total of US$1.4 billion in civil penalties, including a one-time payment of US$1 billion within 60 days of BIS’s June 8, 2018 order, and an additional US$400 million in penalties to be paid within 90 days of BIS’s June 8, 2018 order to a U.S. bank escrow account selected by ZTE and approved by BIS and suspended during the monitoring period.
In addition, only after ZTE pays $1 billion and an additional $400 million to a U.S. bank escrow account will BIS terminate the activation of the denial order and remove ZTE from the Prohibited Export List. If all the above conditions are met and ZTE has been removed from the Prohibited Export List, BIS will make another public announcement.
