After years of negotiations, Indian mobile and video R&D company InterDigital recently filed a lawsuit against Xiaomi in India on the grounds that Xiaomi allegedly infringed its smartphone technology patents, which involved 3G/4G network performance as well as video decoding and image quality.

In the lawsuit, InterDigital accused Xiaomi of using its patented technology in smartphones sold in India, and the company demanded compensation from Xiaomi for its infringement. The relevant patents include five of InterDigital's cellular 3G and 4G patents and three of its H.265/HEVC patents.

In a statement released on Thursday, InterDigital said it had been negotiating for years before attempting to resolve the FRAND licensing issue through binding arbitration.

It is reported that the FRAND scheme allows a company to grant another organization necessary patented technology at a reasonable price.

In addition, InterDigital claims that the company has invested more than 20 years in the research and development of 3G/4G/5G technologies, and the related intellectual property rights have been experienced in more than 32,000 patents and applications worldwide.

“Wireless and video standards play an important role in removing barriers to entry, allowing new companies like Xiaomi to enter the market and succeed despite having no investment in prior wireless research activities,” said William J. Merritt, President and CEO of InterDigital. “Advanced research technologies drive key wireless and video standards, and companies leveraging these technologies receive fair licenses, allowing companies like InterDigital to reinvest in additional research to benefit all users and the industry as a whole.”

InterDigital hopes that the Delhi High Court will support the company's claims, and that in addition to Xiaomi, companies such as Samsung, Apple, and Huawei will also need to pay corresponding patent fees to the company.
