India's antitrust regulator in New Delhi is investigating Google for allegedly using its Android operating system to engage in unfair competition, the Wall Street Journal reported.
The Competition Commission of India reportedly began investigating complaints about Google's unfair competition last year. In light of the EU case, it was not until mid-April this year that the CCI ordered its investigation department to begin a comprehensive investigation into Google, according to people familiar with the matter.
But Google seems to be unaffected by this incident. A Google spokesperson said: "Android has enabled millions of Indians to connect to the Internet more cheaply through their mobile devices. StatCounter data also shows that Android is particularly popular in India, with the operating platform covering 91% of smartphones in India.
A Google spokesperson stressed that Google looks forward to working with the Competition Commission of India to demonstrate how Android can lead to more competition and innovation.”
Officials at the Competition Commission of India declined to comment. Indian officials are expected to complete their investigation in the coming months, during which time they may summon Google executives.
Long before this, Google was accused of forcing manufacturers to pre-install Google Search, Chrome browser and its Google Play app store on Android devices, giving it an unfair advantage. The European Union fined it 4.34 billion euros ($5 billion), and now Google is once again facing allegations of unfair competition.
Gautam Shahi, an antitrust lawyer in New Delhi, said that if Google does abuse its Android operating system, Indian regulators have the power to impose a fine of up to 10% of the company's turnover in the past three financial years. In this case, Google's revenue related to its browser and search engine may be considered for the assessment of the fine.
But for now, there seems to be nothing Google can do except wait for the investigation.
