A German car owner sued Tesla because the FSD function could not be fulfilled. The verdict showed that Tesla was ordered to buy back the owner's Model 3 and refund the FSD software fee.
According to foreign media reports, the German consumer said that after activating Tesla's FSD software, the car was "like a drunk novice driver", unable to overtake on the highway, and did not recognize traffic lights and stop signs. He also claimed that the hardware in his Model 3 was incompatible with ADAS (Advanced Driver Assistance System).
It is not clear why the owner's Tesla FSD does not work properly. However, some foreign media speculated that this should be related to the well-known chip reduction. The new car may not use the HW 3.0 chip, which caused the FSD function to have problems.
On April 22, 2019, Elon Musk promised that all Teslas will be equipped with HW 3.0 hardware and have the necessary computing power to achieve autonomous driving.
But the problem is that many car owners continue to receive cars with HW 2.5. In China, customers complained to the consumer protection agency about this, and Tesla was ordered to replace all chips in new cars. In Canada, there are also car owners who are researching and hope to sue Tesla to get the HW 3.0 version of the chip.
Tesla argues that everyone who paid for FSD will get the HW 3.0 replacement for free once the software is ready. But since FSD is currently in the testing phase, Tesla is exempt from keeping its promise.
In the end, Tesla lost the lawsuit and was not only ordered to refund the owner 6,300 euros in FSD fees, but also ordered by the judge to buy back the Model 3, which costs 69,000 euros. After receiving the result, Tesla said it would appeal the ruling.
