Recently, Hytera, the leader in overseas walkie-talkies, was banned from global sales by the United States, which caused widespread discussion in China.
On the morning of April 8, Hytera announced that it had recently received an order from a U.S. court, which found that the company failed to fully comply with its anti-suit order and temporarily banned the company from selling two-way radio technology products worldwide. And impose a fine of US$1 million per day until the company fully complies with the anti-suit injunction. The company also announced that the controlling shareholder and actual controller Chen Qingzhou voluntarily promised not to reduce its shares in the company within 6 months from now on.
Hytera pointed out that at present, the company has withdrawn the prosecution in the Shenzhen case, and at the same time suspended the sales of two-way radio technology products as required. It has applied to the U.S. court to revoke the above-mentioned order, and hearings are currently ongoing in the U.S. court. The company will further take various countermeasures and strive to revoke the above-mentioned order as soon as possible.
On April 7, Hytera announced on its official website that according to a U.S. court order, Hytera is not allowed to sell any products containing walkie-talkie technology anywhere in the world until further notice.
Previous reports: The ban mainly includes three contents:
1. Sales and distribution ban
Until Hytera complies fully with the Court's counter-injunction order (Documents 1504, 1508), Hytera and all of its officers, agents, employees, affiliates, subsidiaries, distributors, dealers and resellers, and all persons who have actual cooperation or participation with any of the above parties are temporarily prohibited from performing the following acts:
Offer to sell, import, export or distribute any two-way radio product anywhere in the world.
2. Daily fines until Hytera complies with the court order
Hytera is ordered to pay the Court a penalty of $1 million per day until it fully complies with the Court's counter-injunction order (Documents 1504, 1508).
3. Reliance on any order or judgment in Chinese litigation is prohibited
Hytera is ordered not to enforce or rely on any order or judgment issued by a Shenzhen court in the PRC proceedings until the contempt proceedings in the PRC proceedings regarding the H-Series products are concluded.
This order was issued on April 2, 2024. The judge is Martha M. Pacold.
The reason for the ban was allegedly related to an infringement lawsuit filed by Motorola. Chicago-based Motorola claims Hytera is in arrears with royalties on its line of radios, known as the "H Series", and is one of many products that infringes Motorola's trade secrets and copyright protections.
Hytera rejected the above request and filed a lawsuit against Motorola in China, asking the Shenzhen Intermediate People's Court to declare that its H series radio products did not infringe Motorola's trade secrets or copyrights.
A federal judge has opened contempt proceedings against Chinese telecom company Hytera at the request of Motorola. The proposed injunction stemmed from Hytera's failure to withdraw its lawsuit in the Chinese court.
Previously, the U.S. Federal District Court for the Northern District of Illinois required Hytera to "not continue to pursue or enforce" its lawsuit in China on March 25, 2024, and asked Hytera to "withdraw the lawsuit..." on March 29, 2024. …including the withdrawal of all production materials in the case.”
