Dissatisfied with being fired by the company, he wrote a "crawler" program and implanted it into the control platform website, deleting the company's relevant data codes, causing the company to suffer economic losses of more than 100,000 yuan. Recently, Lu Moumou was prosecuted by the Yangpu District Procuratorate of Shanghai for suspected crime of damaging computer information systems.
In March this year, Lu applied for a job at a Beijing-based information technology company's Yangpu subsidiary, where he was responsible for the code development of a coupon, budget and other systems for an online shopping platform. In mid-June of the same year, Lu was fired by the company because his work did not meet the requirements.
"I participated in writing these codes from morning till night, and such a good work has been ruined just like that." After receiving the notice from his supervisor, Lu became angrier and angrier. He felt that he could not just let it go and he had to do something to get revenge, causing chaos to the company.
Therefore, Lu took advantage of the opportunity that his account had not yet been cancelled to log into the company's computer system code control platform and implanted the "crawler" program he wrote into the above system, causing the codes such as coupons, budget systems and subsidy rules originally archived on the platform to be deleted.
In late June, when the company put its budget system online, it discovered that a "crawler" program of unknown origin had been implanted into the system, causing a lot of data and code to be deleted.
"We spent a lot of effort to check the deleted data and found that the relevant data and codes of the three parts that Lu was originally responsible for had been deleted, resulting in the online system being unable to be delivered to merchants for use." said the head of the company's R&D department.
The company immediately organized R&D personnel to screen the computer system and found that the deletion time shown on the server log was the day Lu left the company, and Lu was operating a computer at his workstation at the time. Therefore, they believed that Lu was a major suspect in the crime and immediately reported the case to the public security authorities.
After the public security organs transferred the case to the Yangpu District Procuratorate for review and prosecution, the prosecutors visited a number of computer technology professional institutions to understand the impact of crawling data on computer system data security and to discuss the motivations and consequences of the actor's development of the "crawler" program to implant the system. The prosecutor in charge of the case said that if the actor implanted the network "crawler" program into the target website, it would add, delete, modify, and interfere with the computer information system functions and data of the target website, thereby causing the computer information system to generate a large amount of abnormal data, so that it could not operate normally. It would also delete, modify, add, and other processing of the data and applications stored, calculated, or transmitted by the target website. If the consequences are serious, it will constitute the crime of destroying the computer information system.
The prosecutor in charge of the case believed that Lu used the "crawler" program to delete the code, which caused the company's commercial activities such as coupons to be postponed for 6 days. The third-party data company spent more than 22,000 yuan to restore the database and paid more than 20,000 yuan in overtime pay to employees. The postponement of the activity caused economic losses of more than 100,000 yuan. Lu should be held criminally responsible for the crime of destroying computer information systems.
