Preface:
First of all, let me make it clear that we are not just making headlines. Python is already a very popular programming language. It is basically impossible for any organization or individual to claim it as their own. Today we want to talk about MicroPython, which can be said to be a son of Python. It is derived from Python and is a language specifically used for Microcontroller (microcontroller, single-chip microcomputer) programming.
What is MicroPython:
Simply put, MicroPython is a programming language, a computer science term, and a common programming language in the electronic hardware and computer industries at home and abroad. Like mainstream programming languages (C, Java, C++, PHP, C#, Basic, go, VB, VC++, Delphi, SQL, JavaScript, Python, etc.), its function is to realize the interaction between humans and computers.
The following is the description on MicroPython official website:
The MicroPython programming language was invented by Professor Damien P. George and his team from the Department of Applied Mathematics and Theoretical Physics at the University of Cambridge, UK, and was created and released in 2013. The language technology has been licensed by MIT (MIT is the most relaxed open source license, and users can copy and use it at will). The team has stated on the MicroPython official website (http://www.micropython.org/) that MicroPython is completely open source and free to use, allowing all organizations and individuals to use MicroPython for personal, educational and commercial purposes, and all technical materials are available on GitHub.
(https://github.com/micropython/micropython) is open source for dissemination and promotion. Since its release in 2013, it has received nearly 10,000 Stars.
MicroPython has been widely used in China and abroad in recent years, and is well known in the industry and has a certain influence. Many excellent open source projects are also based on MicroPython.
Since its birth in 2013, many books at home and abroad have been written based on MicroPython:
Complaints of infringement when using MicroPython:
We should promote and apply such a good technology in China. However, in May 2019, many Taobao merchants in our alliance received official complaint letters. The following is a screenshot of the complaint content:
The above picture shows that the complainant is a Taobao seller: Shandong Luobo xx Technology Co., Ltd. The reason is the trademark keyword MicroPython . This scared our alliance partners. Isn't MicroPython allowed to be used as open source? Why did such a complaint occur? And after multiple appeals failed, the product was finally removed from the shelves. In other words, the MicroPython development board related products that have been operated for a year have lost all their good reviews and sales. This is a very fatal blow.
We checked the trademark website and found that the complainant Shandong Luobo xx Technology Co., Ltd. did register the MicroPython Class 9 trademark in mid-2018. In recent years, many foreign open source projects have indeed been registered by some domestic institutions with ulterior motives to attack their peers, such as Arduino and Raspberry Pi. But in the end, all of them were declared invalid.
What surprised us was that Taobao handled trademark infringements incredibly quickly, and no matter how we appealed, the result was the same: the product was removed from the shelves. In desperation, one of the alliance members wrote an article in June titled "I encountered a trademark infringement complaint when promoting MicroPython" , which attracted the support and condemnation of many developers.
But the article was reported shortly afterwards. We won’t speculate on who reported it. Fortunately, Penguin did not remove the article. It seems that the review mechanisms of different platforms are different!
We all thought that the complainant would realize the seriousness of the problem and change his ways, but we were too stupid and naive. On September 10, 2019, another alliance member was complained for the same reason: MicroPython trademark keyword infringement.
This once again caused many MicroPython development boards and related products from Taobao sellers in our alliance to be deleted and taken off the shelves.
The official customer service of Taobao platform responded as shown below. The general content is that our platform is also very disgusted with this complaint, but there is nothing we can do. We are on the same front as your merchants, but we can't help! (I have to say that this is a good way to pass the buck!)
We are really curious why the complainant Shandong Luobo xx Technology Co., Ltd. filed another complaint during this period. When we checked the trademark website again, we found that the complainant had registered MicroPython in Category 35 and passed the registration at the end of August. We all know that if an objection is filed during the trademark publicity period, the Trademark Office will accept it in a timely manner. After passing the registration, the complainant can only apply for invalidation, which takes half a year to one year. It can be said that the complainant's timing is very accurate.
Let's take a look at the other trademarks of the complainant. In addition to MicroPython, MicroBit has also been registered. So here is a reminder for Taobao merchants who sell MicroBit related products to pay attention, as they may also receive related infringement complaints in the future.
September 10th is the traditional Chinese Teachers' Day. In the education-related industry, the complainant's behavior has undoubtedly slapped the domestic open source community enthusiasts in the face, and slapped Mr. Ma who retired on that day and his Taobao platform in the face, making it a long and arduous task to do business in the world . I hope this slap in the face can quickly wake up those responsible for trademark review and Taobao infringement review!
MicroPython Open Source Mutual Aid Alliance was established:
Since the power of an individual is limited, we will unite all forces that can be united to fight against the complaining party. We believe that its behavior has greatly hindered the development and popularity of MicroPython in China. Therefore, we initiated the establishment of the MicroPython Open Source Mutual Aid Alliance, which aims to help MicroPython develop healthily in China and completely shatter the idea of any organization that wants to take the open source technology for itself.
The main goal of the alliance at this stage is to invalidate the MicroPython trademark of the complaining party indefinitely. Since the complaining party can "legally" register the MicroPython trademark, we can also legally invalidate its trademark.
Current alliance members:
Contact Us:
-
If you encounter complaints or unfair treatment in promoting MicroPython, please contact us and we can provide legal advice and assistance;
-
If you are a technical self-media or community, please contact us to forward it so that more people can understand and participate;
-
If you agree with us, please contact us to support or donate. All donation income will be used to invalidate the MicroPython trademark of the complaining party and possible legal proceedings (all income and expenses will be made public).

We believe that justice may be late, but it is never absent! But justice that loses its timeliness may become meaningless. We are determined, capable and necessary to contribute to the promotion of MicroPython in China. Never underestimate the determination of open source enthusiasts and engineers!
We will continue to follow up and announce the progress of related events!
