For some time, the US government has used legislation, administration, justice, diplomacy, and public opinion to suppress Huawei. It is unprecedented for a superpower to use the state machinery to suppress a private enterprise in all aspects and disrupt its normal operations. The new charges against Huawei by the US Department of Justice are a continuation of this action and a political persecution of Huawei.
These charges are not new at all, but are based on civil disputes that Huawei has settled with other companies over the past 20 years. These civil disputes have either been settled by the parties or resolved through litigation, and some have been dismissed by federal judges or juries. In none of these disputes has Huawei been found guilty of maliciously stealing intellectual property, nor has it been required to bear liability for infringement. The U.S. Department of Justice's escalation of these settled civil cases into criminal cases is politically driven selective enforcement, and is also inconsistent with general judicial practice.
It is a common phenomenon for companies to have intellectual property disputes in their global operations. According to public data, from 2009 to 2019, Apple was involved in 596 intellectual property lawsuits, Samsung was involved in 519, and Huawei was involved in 209. The U.S. Department of Justice insisted on filing a criminal lawsuit against Huawei on the grounds of common intellectual property civil disputes in the industry. This is an act of smearing, suppressing and defaming Huawei's advanced technology by the U.S. government, and its fundamental purpose is to combat and curb Huawei's leading edge in the world.
No company can lead the world by stealing. As of the end of 2018, Huawei had obtained 87,805 authorized patents, of which 11,152 were U.S. patents. Since 2015, Huawei has earned more than $1.4 billion in intellectual property revenue. In addition to its own patents, Huawei has paid more than $6 billion in patent fees for the legal use of other companies' patents, of which nearly 80% was paid to U.S. companies.
Huawei has never achieved any product success or technological breakthrough by stealing trade secrets. Huawei's development relies on 30 years of continuous huge R&D investment and the hard work of all employees, and on the trust and support of customers, suppliers and partners.
Suppressing Huawei will not make the United States more advanced, and repeated lies will not become the truth. We believe that the court will make a fair judgment based on facts and evidence.
