On the 3rd, the Ministry of Industry and Information Technology officially issued the "Interim Provisions on the Traceability Management of Recycling and Utilization of Power Batteries for New Energy Vehicles" (hereinafter referred to as the "Power Battery Management Provisions"). The announcement shows that the "Power Battery Management Provisions" will come into effect on August 1, 2018.
The "Power Battery Management Regulations" pointed out that "in accordance with the requirements of the "Interim Measures for the Management of Recycling and Utilization of Power Batteries for New Energy Vehicles" (MIIT Joint Meeting [2018] No. 43), a 'National Monitoring of New Energy Vehicles and Power Battery Recycling and Utilization Traceability Integrated Management Platform' shall be established to collect information on the entire process of power battery production, sales, use, scrapping, recycling, and utilization, and monitor the performance of recycling and utilization responsibilities by the entities in each link"; and emphasized that "automobile production, battery production, scrapped automobile recycling and dismantling and comprehensive utilization companies should establish internal management systems, strengthen traceability management, and ensure that traceability information is accurate and true."
For new energy vehicles that have been produced and imported, Article 4 of the "Power Battery Management Regulations" clearly states that "automakers (including importers) shall upload relevant traceability information to the traceability management platform for new energy vehicle products that have been produced and imported but not included in the traceability management within 12 months of the implementation of these regulations."
The Power Battery Management Regulations provide detailed rules for the repair, replacement and recycling of new energy vehicle batteries. Article 10 states that "repairers and battery leasing companies that cooperate with automobile manufacturers should promptly report information to automobile manufacturers after the repair and replacement of power batteries. Automobile manufacturers should upload traceability information within 30 working days after the repair and replacement of power batteries." Article 11 emphasizes that "recycling service outlets should report information to automobile manufacturers after the recycling and transfer of used power batteries. Automobile manufacturers should upload information within 30 working days after the used power batteries are collected and transferred out of the warehouse."
Regarding the treatment of scrapped new energy vehicles, Article 13 of the "Power Battery Management Regulations" states that "scrapped vehicle recycling and dismantling companies should upload information within 15 working days after receiving scrapped new energy vehicles and issuing a "Scrapped Vehicle Recycling Certificate"; upload information within 15 working days after the used power batteries are dismantled and handed over to the warehouse"; and Article 15 emphasizes that "recycling companies should upload information within 30 working days after receiving used power batteries into the warehouse; upload information within 30 working days after completing recycling and final treatment."
Appendix: Original text of the Interim Provisions on Traceability Management of Recycling and Utilization of Power Batteries for New Energy Vehicles
Article 1 In accordance with the requirements of the Interim Measures for the Management of Recycling and Utilization of Power Batteries for New Energy Vehicles (MIIT Joint Meeting [2018] No. 43), a "National Monitoring and Traceability Integrated Management Platform for New Energy Vehicles and Power Battery Recycling" (hereinafter referred to as the Traceability Management Platform) shall be established to collect information on the entire process of power battery production, sales, use, scrapping, recycling, and utilization, and monitor the performance of recycling and utilization responsibilities by the entities in each link.
Article 2 From the date of implementation of these Regulations, traceability management shall be implemented for new energy vehicle products that have newly obtained the "Announcement of Road Motor Vehicle Manufacturers and Products" (hereinafter referred to as the "Announcement") and imported new energy vehicles that have newly obtained compulsory product certification.
Article 3 For new energy vehicle products that have obtained the Announcement and imported new energy vehicles that have obtained compulsory product certification before the implementation of these regulations, the traceability management will be postponed for 12 months from the date of implementation of these regulations. If power batteries that are not coded according to national standards are still needed in maintenance after the expiration of the period, an explanation should be submitted.
Article 4 Automobile manufacturers (including importers) shall upload the relevant traceability information to the traceability management platform for new energy vehicle products that have been produced and imported but not included in the traceability management within 12 months of the implementation of these regulations.
Article 5 From the date of implementation of these regulations, traceability management shall be implemented for second-life battery products.
Article 6 Battery production and recycling enterprises shall apply for manufacturer codes and register coding rules in accordance with the requirements of the "Notice on the Opening of the Automotive Power Battery Coding and Registration System" (Zhongji Letter [2018] No. 73), and code and identify the power batteries or recycled battery products produced by the enterprise.
Article 7 Automobile production, scrap automobile recycling, dismantling and comprehensive utilization enterprises shall apply for an account on the traceability management platform (see Appendix 1 and 2 for application materials). Each enterprise shall upload traceability information on the traceability management platform (see Appendix 3). Automobile production enterprises shall submit recycling service outlets information (see Appendix 4) and publish it to the public on the enterprise website.
Article 8 Automobile manufacturers should upload information within 15 working days after issuing the factory certificate for domestically produced new energy vehicles, and importers should upload information within 15 working days after imported new energy vehicles pass customs and complete inspection and quarantine.
Article 9: Sellers cooperating with automobile manufacturers shall promptly submit record information to automobile manufacturers after the sale of vehicles, and inform vehicle owners of the requirements and procedures for updating record information when the record information changes. Automobile manufacturers shall upload information within 30 working days after the vehicle is sold and the vehicle owner's record information is updated.
Article 10 Repairers and battery leasing companies cooperating with automobile manufacturers shall promptly report information to automobile manufacturers after the repair or replacement of power batteries. Automobile manufacturers shall upload traceability information within 30 working days after the repair or replacement of power batteries.
Article 11 Recycling service outlets shall submit information to automobile manufacturers after recycling and transferring used power batteries. Automobile manufacturers shall upload information within 30 working days after the used power batteries are recycled into the warehouse or transferred out of the warehouse.
Article 12 New energy vehicle sellers, repairers, lessors, etc. that have not cooperated with automobile manufacturers should submit applications through the traceability management platform in accordance with Article 7 and upload information to the traceability management platform in accordance with the time limits specified in Articles 9 and 10.
Article 13 Scrapped vehicle recycling and dismantling enterprises shall upload information within 15 working days after receiving scrapped new energy vehicles and issuing a "Scrapped Vehicle Recycling Certificate"; and upload information within 15 working days after dismantling and handing over the used power batteries from the warehouse.
Article 14 Recycling enterprises shall upload information within 15 working days after the recycled battery products are shipped out of the warehouse; waste power batteries generated during the production, testing, and use of recycled batteries shall upload information within 15 working days after they are recycled into the warehouse and transferred out of the warehouse.
Article 15 Recycling enterprises shall upload information within 30 working days after receiving and storing used power batteries; and upload information within 30 working days after completing recycling and final treatment.
Article 16 Automobile production, battery production, scrapped automobile recycling, dismantling and comprehensive utilization enterprises should establish internal management systems, strengthen traceability management, and ensure that traceability information is accurate and true.
Article 17 The provincial industrial and information technology department shall, together with relevant departments at the same level, supervise and inspect the fulfillment of traceability responsibilities by relevant enterprises in the region.
Article 18 The relevant terms and definitions in the Interim Measures for the Management of Recycling and Utilization of Power Batteries for New Energy Vehicles shall apply to these Regulations.
Article 19 These Regulations shall come into force on August 1, 2018.
