Apple compromises with Dutch dating app to support third-party payment system

      On the morning of March 31, Apple announced today that dating apps in the Dutch App Store can support the access of third-party applications, no longer a "choose one or the other", but it is limited to the Netherlands and devices running iOS or iPadOS.

  This means that after being fined ten times totaling 50 million euros by the Netherlands Authority for Consumers and Markets (ACM), Apple has finally compromised.

  Currently, developers can 1:) continue to use Apple's in-app purchasing system, 2) use a third-party payment system within the app, or 3) include an in-app link directing users to the developer's website to complete the purchase.


  Apple also announced two other changes that apply to dating apps in the Netherlands that accept alternative payment methods:

  Third-party payment service provider criteria: Apple is providing more specific criteria to evaluate third-party payment services for use in Dutch dating apps.

  Consumer Disclosures: Apps that use two payment systems will need to include an in-app form explaining to users that they will be making a purchase through an external payment system and the potential impact this choice may have on users. Apple is adjusting the language of the form to reduce the number of times it is displayed.

  In December 2021, the Netherlands Authority for Consumers and Markets (ACM) announced that Apple must allow dating apps to support payment methods other than Apple's existing in-app purchase system in the Dutch App Store, otherwise it will face fines. Apple initially allowed dating apps in the Netherlands to use third-party payments, but required developers to choose from multiple payment systems.

  This conditional support was not accepted by the ACM, which said Apple had failed to meet its demands. Since then, Apple has been fined €5 million per week, bringing the total fine to €50 million, and the ACM said the fine could go even higher.

  In today's statement, Apple said that the changes they announced today show that the company has fulfilled its legal obligations in the Netherlands. At the same time, Apple reiterated that they disagree with the order and are appealing.

  At present, ACM has not announced whether Apple's changes today have met its requirements.
